1. Service Provider Identification

The QuéComí service is operated by Jorge Galván González, an individual, located in Monterrey, Mexico. For legal matters, claims, or questions about these terms, you may contact us at legal@quecomi.com.

2. Acceptance of Terms

By accessing, registering for, or using QuéComí, you agree to comply with these terms and conditions in full. If you do not agree with any part of these terms, you must not use our service. Continued use of the service constitutes acceptance of any subsequent modifications.

3. Use of the Service

QuéComí is a nutritional tracking service that allows you to log and analyze your food intake through WhatsApp.

You agree to:

• Provide accurate and truthful information
• Not use the service for illegal or unauthorized purposes
• Keep your account credentials confidential
• Not share your account with third parties
• Not attempt to access systems, data, or accounts belonging to others
• Not use the service if you have medical conditions requiring professional supervision without having consulted a professional

4. Subscriptions and Payments

By subscribing to our plans, you agree to pay the applicable fees according to the plan selected. Subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You may cancel your subscription at any time from your account settings.

Refund policy: We do not offer refunds for billing periods already charged. If you cancel your subscription, you will retain access to the service until the end of the period already paid for. In exceptional cases and at our sole discretion, we may consider refund requests for billing errors or serious technical failures.

If a renewal payment fails (expired card, insufficient funds, etc.), we will attempt to charge again. If non-payment persists, we may suspend or terminate your access to the service until payment is regularized.

5. Intellectual Property

All QuéComí content, including but not limited to text, graphics, logos, software, databases, and the overall design of the service, is the property of Jorge Galván González and is protected by intellectual property laws. Copying, modifying, distributing, or commercial use of the content without express written authorization is not permitted.

6. Disclaimer of Warranties and Limitation of Liability

Disclaimer of warranties: The service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Not medical advice: QuéComí provides nutritional information for informational and tracking purposes only. It does not replace and does not constitute medical advice, diagnosis, treatment, or professional recommendation. Always consult a physician, nutritionist, or healthcare professional before making significant changes to your diet, especially if you have medical conditions, are pregnant, have allergies, or dietary restrictions.

Limitation of liability: To the maximum extent permitted by applicable law, in no event shall Jorge Galván González be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, emotional distress, lost business opportunity, or any other damage arising from the use or inability to use the service. Total liability, in any case, shall not exceed the amount you paid for the service in the twelve (12) months prior to the event giving rise to the claim, or one hundred US dollars (USD 100), whichever is greater.

We are not responsible for decisions you make based on information provided by the service, nor for results that are not achieved. The user assumes full responsibility for their use of the service and their health and nutrition decisions.

7. Service Termination

We reserve the right to suspend or terminate your account, without prior notice or liability, if we determine that you have breached these terms, used the service fraudulently or abusively, or for any other reason at our discretion. You may delete your account at any time from settings. Upon account deletion, your data will be removed as set forth in our Privacy Policy.

8. Modifications

We reserve the right to modify these terms at any time. We will notify you of significant changes by email to the address associated with your account or through the application. Continued use of the service constitutes acceptance of the modified terms. If you do not accept the changes, you must stop using the service and delete your account.

9. Geographic Scope and International Use

The service operates from Mexico and may be accessed from any country. If you access or use the service from outside Mexico, you do so on your own initiative and are responsible for complying with applicable local laws in your jurisdiction.

The service may be unavailable, illegal, or inappropriate in certain jurisdictions. We reserve the right to limit or restrict access to the service in certain countries. By using the service from any location, you agree that any dispute will be resolved in accordance with Section 10.

10. Governing Law and Jurisdiction

These terms are governed exclusively by the laws of Mexico, without regard to conflict-of-law principles. For any controversy, claim, or dispute arising from these terms or use of the service — regardless of the country from which you access the service — the parties irrevocably submit to the exclusive jurisdiction of the competent courts of Monterrey, Mexico, expressly waiving any other venue that may apply based on domicile, nationality, or any other criterion.

By using the service, you agree that any lawsuit or legal proceeding must be initiated solely in Monterrey, Mexico. If a court in another jurisdiction declares this clause unenforceable or void, the parties agree to submit to arbitration in Mexico under the rules of a recognized arbitration institution, in Spanish.
